AMD chief executive Lisa Su says the company is authorised to ship certain MI308 artificial-intelligence chips to China and is ready to pay a 15% fee to the U.S. government should those exports move ahead. Speaking at a Wired event in San Francisco, Su confirmed AMD holds the required licenses under the Biden-era export controls and the more recent arrangements introduced by President Donald Trump.
The fee stems from an August agreement that allowed AMD and Nvidia to restart limited, license-based shipments of advanced chips to China in exchange for a 15% payment to Washington. The mechanism has raised eyebrows among legal scholars, who argue it could clash with the U.S. Constitution’s prohibition on federal taxes on exports.
Despite the controversy, AMD appears prepared to comply with the framework, positioning itself to serve Chinese demand within the narrow technical limits permitted under U.S. national-security rules.
