This isn't as bad as it sounds. The notification to Congress can't be made on a two-party agreement. The authorization to Congress was for a three-party deal under fast track provisions so they will have to start from scratch if it's Mexico only.
So what's really happening here is they're giving notice but there's an assumption that Canada will join on before the end of September, which is probably the real deadline. But it's a deadline to deliver the finished text, so you'd still have to have a handshake agreement sooner.
A separate report says Canadian officials are returning to Ottawa tonight.
